Exemption Statement – Content Produced by Operators:

For all visual depictions on this website where the operators of Kelly’s Dreamland may be considered the "producers," such content is exempt from the requirements of 18 U.S.C. § 2257 and 28 C.F.R. § 75 because:

• The content does not depict actual sexually explicit conduct as defined in 18 U.S.C. § 2256 (2)(A)(i)–(iv);

• It does not portray actual or simulated genital or pubic area exposure created after July 27, 2006;

• It does not include simulated sexually explicit activity created after the effective date of Title 18 U.S.C. § 2257A;

• Or, the material was created prior to July 3, 1995.

 

Exemption Statement – Content Produced by Third Parties:

Kelly’s Dreamland and its operators are not considered the primary producers of any visual depictions of actual or simulated sexually explicit conduct uploaded or submitted by third-party contributors. Our role is limited to hosting, formatting, transmitting, or storing user-submitted content in areas under the user's control.

As such, we are exempt from the 2257 record-keeping and labeling obligations under 28 C.F.R. § 75.1(c)(4), and in accordance with 18 U.S.C. § 2257 (h)(2)(B)(v) and 47 U.S.C. § 230(c). Kelly’s Dreamland reserves the right to remove any user-submitted content deemed to be obscene, defamatory, or otherwise inconsistent with our community standards and terms of service.
