Notice of Claimed Infringement

If you believe that your copyrighted work has been used on our platform in a manner that constitutes infringement, please submit a written notice including the following:

1. Your physical or electronic signature;

2. A description of the copyrighted work that you claim has been infringed;

3. The exact location (URL or detailed path) of the material on our platform;

4. Your full name, address, telephone number, and email address;

5. A statement that you have a good faith belief that the disputed use is unauthorized;

6. A statement, under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.

Takedown Procedure

Upon receipt of a valid DMCA notice, Kelly’s Dreamland will promptly investigate and, if appropriate, remove or disable access to the allegedly infringing content. We will notify the affected user and, where applicable, disable repeat infringer access in accordance with DMCA compliance standards.

If the notice is incomplete, we will attempt to contact the complainant to help them meet the legal requirements.

DMCA Counter-Notification Procedure

If you believe your content was removed in error, you may submit a counter-notification to the DMCA Agent including:

1. A description of the content that was removed and where it appeared;

2. A statement under penalty of perjury that you believe the material was removed due to mistake or misidentification;

3. Your name, address, phone number, and email;

4. A statement consenting to jurisdiction in the federal court of your district (or any district if outside the U.S.) and that you will accept service of process from the original complainant.

Upon receipt of a valid counter-notification, Kelly’s Dreamland will forward it to the original complainant. Unless we receive notice within 10–14 business days that legal action has been initiated, we will restore the removed content.

Third-Party Service Providers

If the alleged infringer operates as a separate service provider, we request that the copyright owner contact that provider directly, as required by the DMCA.

Abuse and Misuse

Knowingly submitting false or misleading information in a DMCA notice or counter-notice may expose the submitting party to legal liability under 17 U.S.C. § 512(f).
