Intellectual Property

Purpose

The intent is to safeguard the creative contributions of individuals while protecting the integrity, reputation, and assets, including copyrights, trademarks, and other proprietary rights of Kelly’s Dreamland (hereafter, “KD”).

 

Scope

This policy applies to:

• Performers: Artists, entertainers, and demonstrators engaged in live or recorded acts.

• Practitioners: Educators, facilitators, service providers, and workshop leaders.

• Contractors: Independent contractors, vendors, or consultants providing goods or services.

• Sponsors: Organizations or individuals supporting KD through financial or in-kind contributions.

• Members: Registered participants of KD membership programs.

• Guests: Non-member attendees of KD events, retreats, or productions.

 

Ownership of Intellectual Property

 

1.1 KD Intellectual Property

• All KD branding, logos, event names, program titles, taglines, marketing collateral, photographs, recordings, stage/set designs, scripts, handbooks, training guides, online content, and proprietary frameworks are the exclusive property of KD.

• KD’s trademarks (both registered and unregistered), copyrights, and proprietary materials may not be used without prior written consent.

• Unauthorized reproduction, modification, distribution, or commercial use of KD IP is strictly prohibited and may constitute infringement under applicable copyright and trademark laws.

 

1.2 Performer & Practitioner Works

• Original Acts, Performances, and Educational Content created by performers or practitioners remain their intellectual property unless otherwise agreed in writing.

• Performers and practitioners are responsible for ensuring their works do not infringe upon third-party copyrights, trademarks, or other intellectual property rights.

• By participating in KD events, performers and practitioners grant KD a non-exclusive, royalty-free, worldwide license to record, reproduce, display, distribute, and promote their participation for marketing, educational, and archival purposes.

 

1.3 Contractor Contributions

• Any materials, deliverables, or works-for-hire produced under contract with KD shall be deemed the property of KD, unless explicitly stated otherwise in the contractor agreement.

• Contractors agree not to use KD’s trademarks, copyrighted content, or proprietary frameworks outside the scope of their engagement without authorization.

 

1.4 Sponsors

• Sponsors may only use KD’s name, logos, trademarks, or event materials in approved co-branding or promotional campaigns with prior written consent.

• Unauthorized use of KD trademarks or copyrighted materials by sponsors may result in termination of sponsorship agreements and legal enforcement.

 

1.5 Members & Guests

• Members and guests may not record, distribute, reproduce, or commercially exploit any KD events, workshops, performances, or experiences without express written permission.

• Any content voluntarily shared by members or guests within KD spaces (e.g., testimonials, feedback, participation in recordings) may be used by KD for promotional or archival purposes, unless otherwise restricted in writing.

• Unauthorized use of KD’s copyrighted works, trademarks, or brand identifiers by members or guests is strictly prohibited.

 

Media & Recordings

• KD reserves the right to record, photograph, and/or live-stream all or part of its events, workshops, or experiences.

• By attending, all participants (performers, practitioners, contractors, sponsors, members, and guests) grant KD consent to use their likeness, image, voice, and participation in any media format for KD’s purposes, unless explicitly opted out in writing prior to the event.

• Unauthorized photography, video recording, or live-streaming by attendees is prohibited unless expressly permitted.

 

Confidentiality & Restricted Content

• Certain workshops, demonstrations, or discussions may include sensitive or community-protected information. Unauthorized reproduction, disclosure, or distribution of such content is prohibited.

• Members, practitioners, contractors, and guests are expected to respect the privacy and confidentiality of all participants.

 

Enforcement

Violation of this policy may result in:

• Removal from KD events.

• Revocation of membership or participation privileges.

• Termination of contracts or sponsorship agreements.

• Pursuit of legal remedies, including claims for copyright and trademark infringement, damages, or injunctive relief.

 

Amendments

KD reserves the right to update or amend this Intellectual Property Policy at any time. All participants will be notified of substantive changes. Continued participation in KD programming constitutes agreement to the updated terms.
